Terms of Service
Version 1.0 · Effective October 6, 2026
1. Agreeing to these terms
Motor is owned and run by Motor Software Corporation ("Motor," "we," "us"). By creating an account, using motor.dev, or calling the Motor API (yourself or through an AI agent you control), you agree to these Terms of Service and our Privacy Policy. Some features may have their own extra rules, which we'll post with the feature. Those rules are part of these terms too.
You must be at least 18 to use Motor. If you use Motor for a company, you confirm you have the authority to agree on its behalf. If you don't agree, please don't use Motor.
Please note: Section 10 says that most disputes between you and Motor will be settled by individual arbitration, not in court. It also means you give up the right to a jury trial and to join a class action. You can opt out of arbitration within 30 days, as explained in section 10.
2. The service
Motor gives businesses and their AI agents one account, one API, and one bill for a growing catalog of business services. Motor has three parts: the website at motor.dev, the API at motor.dev/api, and an admin area where your team manages members, API keys, and billing.
Motor builds and runs its services itself rather than reselling other companies' products. Services marked as available on motor.dev can be used today, such as embeddings, feature flags, key-value storage, queues, search, and uptime monitoring. Services marked as upcoming aren't available yet, and we don't promise when or whether they'll launch.
- Changes to the API: Motor will keep improving. Where practical, we'll give reasonable advance notice by email before we make a change that breaks existing integrations or retire a service that's marked as available.
- Upcoming and beta services: Anything marked as upcoming, beta, or preview is offered as is, may change or end at any time, and isn't covered by any promise in these terms.
- Rate limits: We may set reasonable limits on how fast or how much you can call an API to keep Motor running well for everyone.
- No uptime guarantee: We aim for high availability, but there's no service level agreement (SLA) unless we sign one with you.
- Support: You can reach us at hi@motor.dev and we'll try to help, but Motor isn't obligated to provide support or maintenance unless we agree to it in writing.
3. Your account and fair use
You sign up and sign in with a Google account and a passkey. Each account belongs to one team, and team admins can invite members, set roles, create and revoke API keys, set spending limits, and manage billing. Keep your account information accurate and up to date.
Your team is responsible for its accounts and API keys, and everything done with them, including anything your AI agents do. Keep secret keys private, and roll or revoke any key you think has leaked. You can delete your own account at any time, and an admin can delete the team.
Please don't use Motor to:
- Break any law, or help someone else break one
- Share content that infringes anyone's rights (copyright, trademark, privacy, publicity), or that is threatening, harassing, defamatory, obscene, hateful, or harmful to children
- Send spam, scams, phishing, chain letters, or pyramid schemes, or impersonate anyone
- Upload viruses or other harmful code
- Collect other people's data, like email addresses, without their consent
- Hack, overload, disrupt, or reverse-engineer Motor or our providers, or get around usage limits
- Scrape motor.dev or create accounts in bulk with scripts (calling the API as intended is fine)
- Build a competing product by copying Motor, or resell Motor itself
Also don't share, sell, or trade API keys outside your team, or get around rate or spending limits. If you build a product on Motor, you're responsible for how your own users and agents use it, and for making sure they follow these rules too.
Suspension: We may suspend your team's access, in whole or in part, if you break these rules, your account poses a security risk to Motor or others, we see fraud, payment is overdue, or the law requires it. We'll suspend only as much as needed, tell you why where it's safe and legal, and restore access once the problem is fixed. We may also report illegal activity to law enforcement.
4. Pricing, payment, and refunds
Motor is pay-as-you-go. Each service has a published price per unit (per request, per 1,000 searches, per GB, and so on), listed on motor.dev. Motor counts what each API key uses and bills your team once a month for the month before.
- Payments: A team admin adds a card, which is stored and charged by Stripe. Motor never sees your full card number. On the first of each month we create your invoice and Stripe charges the card and emails a receipt to your billing email. Stripe's privacy policy is at stripe.com/privacy.
- Spending limits: Admins can set a monthly limit on each API key. We email admins as a key approaches its limit, and calls that would go over it are refused until the next month or until the limit is raised.
- Price changes: Prices may change. We'll email you and update motor.dev at least 30 days before a price increase takes effect. Lower prices can take effect right away.
- Taxes: Prices don't include taxes unless we say so. You're responsible for applicable taxes.
- Refunds: Because usage is consumed as it happens, charges for usage are generally non-refundable. If we billed you by mistake, or a service failed on our side, tell us within 30 days of the invoice at hi@motor.dev and we'll correct it, usually with a credit on your account that applies to future invoices. Any other refunds or credits are at Motor's discretion.
- Unpaid bills: If a card charge fails, we'll contact you to sort it out. If it's still unpaid after that, we may suspend your team's API access until it's paid. The fees are still owed either way.
- Deleting a team: When an admin deletes a team, its keys stop working right away and we charge the card for usage up to that point.
5. What you own
Your content: You own what you put into Motor (your data, prompts, files, and messages) and what Motor produces for you (AI outputs, documents, reports, and other results). We don't claim ownership of any of it. You're responsible for your content, including making sure you have the right to use it, and for keeping your own backups. We don't promise to store it.
What you let us do with it: You give us a worldwide, royalty-free permission to host, copy, process, and send your content, and to let our hosting and infrastructure providers do the same, only as needed to run Motor for you. We don't use your content to train AI models.
What we own: Motor Software Corporation owns Motor itself: the website, platform, software, API, documentation, and brand. We give you a limited, revocable, non-transferable right to use Motor under these terms. Everything else stays ours. The Motor name and logo are our trademarks, and other marks shown on the site belong to their owners. You can't use any of them without permission. © Motor Software Corporation. All rights reserved.
Feedback: If you send us ideas or suggestions, we're free to use them in any way without paying you or keeping them confidential.
Third-party links: Motor may link to other websites and services. We don't control them and aren't responsible for them, and their own terms and privacy policies apply.
AI outputs: AI outputs can be wrong, and similar requests from other users may produce similar results. Check outputs before relying on them.
Your permission to share data with us: If you send us information about other people, like your customers or employees, you confirm you've given them any notices and have any consents the law requires. For that data, Motor acts as your processor, as our Privacy Policy explains. Business customers who need a data processing agreement (DPA) for GDPR can ask for one at hi@motor.dev.
Confidentiality: Each of us may share non-public information with the other, such as your service data or our unreleased plans and private pricing. We'll each use the other's confidential information only for this agreement, protect it at least as well as our own, and share it only with people who need it and are bound to keep it confidential. This doesn't cover information that's already public or that we're legally required to disclose (and we'll give notice when we're allowed to).
Publicity: We won't use your company's name or logo in our marketing without your permission.
6. Copyright complaints
We respect other people's intellectual property and expect our users to do the same. If you believe something on Motor infringes your copyright, send a written notice to our copyright agent with:
- Your physical or electronic signature
- The copyrighted work you believe was infringed
- The material you want removed, and enough detail for us to find it
- Your address, phone number, and email
- A statement that you believe in good faith the use isn't authorized by the owner, its agent, or the law
- A statement, under penalty of perjury, that your notice is accurate and that you own the copyright or are authorized to act for the owner
False claims can make you liable for damages and legal fees under 17 U.S.C. § 512(f). We'll remove infringing material and close the accounts of repeat infringers when appropriate.
Copyright agent: Copyright Agent, Motor Software Corporation, 2810 N Church St, PMB 59881, Wilmington, Delaware 19802-4447, hi@motor.dev.
7. Privacy
Our Privacy Policy explains what information we collect, including cookies and usage data, who we share it with, and your rights under laws like GDPR and the CCPA. It is part of these terms.
8. Changes to these terms
We may update these terms as Motor grows. For important changes, we'll email the address on your account at least 30 days before they take effect, and post a notice on motor.dev. Please keep your email current: a notice sent to the last address you gave us counts, even if it bounces. For small changes, like fixing typos, we'll update this page and the date at the top. If you keep using Motor after a change takes effect, you accept the new terms. If you don't, you can close your account at any time. Changes to the arbitration section follow the special rule in section 10.
9. Disclaimers, liability, and ending the agreement
We work hard to keep Motor reliable and secure, and we act in good faith with your service and your data. Still, no service is perfect, so these protections apply.
- As is: Motor is provided "as is" and "as available." To the extent the law allows, we and our providers make no promises that it will meet your needs, be uninterrupted, error-free, secure, or virus-free, or that results will be accurate. Where the law requires a warranty anyway, it lasts 90 days from your first use. Some places don't allow these limits, so they may not all apply to you.
- Limit on liability: To the extent the law allows, Motor and our providers aren't liable for lost profits, lost data, the cost of replacement services, or any indirect, incidental, special, or punitive damages, even if we were warned they might happen. Our total liability for all claims is limited to the greater of $50 or what you paid us in the 12 months before the claim. This limit doesn't reduce what you owe us for fees or under the next point.
- Your responsibility to us: If someone makes a claim against Motor because of your use of Motor, your content, or your breaking these terms or the law, you'll cover our costs, including reasonable legal fees. We can choose to handle the defense ourselves, and you'll cooperate. You won't settle a claim that involves us without our written OK.
- Release: You release Motor from claims arising from your dealings with other users, third-party providers, or third-party links. If you live in California, you waive California Civil Code § 1542, which otherwise limits releases to claims you knew about at the time.
- Ending the agreement: These terms apply for as long as you use Motor. You can stop and close your account at any time. We can suspend or end your access at any time, including for breaking these terms, and your content may then be deleted, so export anything you want to keep first. You still owe for usage up to that point. Sections that by their nature should continue (like ownership, payment owed, disclaimers, liability, indemnity, and disputes) still apply afterward.
10. Resolving disputes
If something goes wrong, we'd much rather fix it with you directly. Here's how disputes work.
- Talk first. Before either of us starts arbitration or a small-claims case, the one with the dispute sends written notice to the other. Send yours to hi@motor.dev or to the mailing address in section 11, with your name, phone, mailing address, account email, your lawyer's details if you have one, and what the dispute is about. We'll then meet by phone or video within 45 days to try to resolve it, one dispute at a time. Deadlines to file are paused while we do this.
- Then arbitration. If it isn't resolved within 60 days of the notice, either of us can start binding arbitration with JAMS, under its Streamlined Rules for claims under $250,000 and its Comprehensive Rules otherwise. The Federal Arbitration Act applies. Arbitration takes place in the county where you live unless we agree otherwise, and it stays confidential. The arbitrator decides most questions, issues a written decision, and the decision is final. Courts decide questions about the class-action waiver, fees, whether the talk-first step was done, and which version of this section applies.
- Exceptions. Either of us can still use small claims court for individual claims, go to court over misuse of intellectual property, or raise issues with a government agency.
- No jury, no class actions. You and Motor each give up the right to a jury trial, and to bring or join a class, collective, or representative action. Claims can only be brought individually. If a court finds this waiver can't apply to a particular claim (such as a request for public injunctive relief), only that claim goes to the state or federal courts in Delaware.
- Legal fees. Each of us pays our own legal fees, unless the arbitrator finds a claim was frivolous or brought for an improper purpose. Whoever has to go to court to enforce this section can recover their costs.
- Mass filings. If 100 or more similar claims are filed by the same law firm or group within 30 days, JAMS will handle them in batches of 100, each with one arbitrator and one set of fees.
- Opting out. You can opt out of arbitration by emailing hi@motor.dev or writing to the mailing address in section 11 within 30 days of first agreeing to these terms. Include your name, address, and a clear statement that you're opting out. The rest of these terms still apply.
- Time limits. Claims must be started within the legal time limit that would apply in court.
- Changes to this section. If we make a material change to this section, you can reject it by writing to us within 30 days of it taking effect. The version you last accepted will then keep applying.
11. Other legal basics and contact
- Delaware law: These terms are governed by the laws of the State of Delaware, where Motor Software Corporation is incorporated, except where the Federal Arbitration Act applies. Any court case allowed under section 10 will be heard in the state or federal courts in Delaware. You agree to use Motor within the reasonable bounds of applicable law.
- Export rules: Motor may be subject to U.S. export laws. Don't export or transfer anything from Motor in violation of them.
- California residents: You can report complaints to the Complaint Assistance Unit of the Division of Consumer Services, California Department of Consumer Affairs, 400 R Street, Sacramento, CA 95814, or (800) 952-5210.
- Electronic notices: You agree to receive notices and agreements from us by email or on the site, and that they count as "in writing."
- Whole agreement: These terms, with the Privacy Policy and any feature rules, are the whole agreement between you and Motor. If part of them can't be enforced, the rest still applies. Not enforcing a term right away doesn't mean we've given it up. "Including" means "including without limitation," and headings are just for convenience.
- Transfers: You can't transfer these terms without our written OK. We can transfer them, for example if Motor is sold.
- Independent parties: Nothing here makes you and Motor partners, employees, or agents of each other.
- Sanctions: You can't use Motor if you're in a country under U.S. embargo or on a U.S. government list of restricted parties, or on behalf of anyone who is.
- Events beyond our control: Neither of us is responsible for delays or failures caused by things outside reasonable control, like natural disasters, outages at internet or cloud providers, war, or government action. This doesn't excuse paying fees you owe.
- Notices: We'll send notices to your account or billing email. Send notices to us at hi@motor.dev or our mailing address below.
- No third-party rights: These terms are only between you and Motor. Nobody else can enforce them.
